A Nairobi court has postponed the adoption of a settlement agreement between Mumias East MP Peter Salasya and the National Cohesion and Integration Commission (NCIC), citing that key conditions of the deal remain unfulfilled.

The court was informed that MP Salasya and NCIC had reached an agreement outlining undertakings by the legislator aimed at promoting national cohesion and peaceful coexistence. The prosecution indicated its intention to apply for withdrawal of the case under Section 78A of the Criminal Procedure Code once the terms were met.

However, the magistrate noted that certain obligations including holding a press conference to issue a public apology and conducting a social media campaign advocating for peace and unity had not yet been implemented.

“These are events you agreed to undertake,” the magistrate stated, declining to adopt the agreement immediately. “I will give you the chance to implement the agreed terms, after which the court will adopt the agreement.”

The matter will be mentioned on a later date to verify compliance and consider the withdrawal application.

Through his lawyer, MP Salasya expressed gratitude to the Director of Public Prosecutions and NCIC for agreeing to an out-of-court settlement, highlighting that the move would help save judicial resources.

The case against Salasya stems from remarks allegedly made during a public event last year, which the DPP described as inflammatory and potentially inciting ethnic tension.
