Brazil Court Acquits Flávio Bolsonaro Over AI Deepfake of Father

Brazilian presidential candidate Flávio Bolsonaro has been cleared of an alleged electoral law violation after the Superior Electoral Court ruled Tuesday that he did not breach campaign regulations by broadcasting an artificial intelligence-generated video of his father, former president Jair Bolsonaro.

The case was brought by a left-wing coalition supporting President Luiz Inácio Lula da Silva's re-election bid. The coalition accused Flávio Bolsonaro of violating electoral rules that prohibit the use of AI-generated replicas of real people in political campaigns.

The Superior Electoral Court ruled in favour of the conservative candidate in a five-to-two decision, with Justice Kassio Nunes Marques explaining that the event at which the video was shown took place before the official start of the election campaign period.

AI Video Showed Jair Bolsonaro Endorsing His Son

The deepfake video was screened in July during an event marking Flávio Bolsonaro's formal launch as a presidential candidate.

In the digitally generated footage, an AI replica of Jair Bolsonaro appeared to address supporters and endorse his son as his preferred successor.

The avatar acknowledged that the image and voice were AI-generated before delivering what appeared to be an endorsement of Flávio's candidacy.

However, lawyers representing Jair Bolsonaro said the former president had not authorised the use of the AI-generated video.

The episode has highlighted growing concerns in Brazil and elsewhere over the use of artificial intelligence in political campaigns, particularly the potential for digitally manipulated images and voices to influence voters.

Jair Bolsonaro Under Restrictions

The dispute comes as Jair Bolsonaro remains subject to significant legal restrictions following his conviction in a case involving an alleged attempt to overturn Brazil's democratic order.

The 71-year-old former president served several months in prison before being transferred to home confinement in March on health grounds.

He is currently prohibited from using social media and mobile phones and is not permitted to make public statements.

The restrictions have complicated his ability to participate directly in his political movement ahead of the October presidential election.

Flávio Bolsonaro Also Barred From Visiting Father

In a separate development, Brazil's Supreme Court on July 13 barred Flávio Bolsonaro from visiting his father until after the first round of the election.

The decision followed an incident in which Flávio read a handwritten letter from Jair Bolsonaro on social media, despite restrictions placed on the former president's public communications.

The latest court ruling on the AI-generated video does not resolve the broader political and legal disputes surrounding the Bolsonaro family, but it allows Flávio's campaign to proceed without an electoral penalty over the July incident.

Brazil Heads Toward October Election

Brazil's first round of presidential voting is scheduled for October 4, with President Luiz Inácio Lula da Silva seeking re-election.

Recent opinion polls have shown Lula maintaining a narrow lead, setting the stage for a closely contested campaign.

The dispute over the AI-generated video is likely to add to the debate over how political campaigns should regulate artificial intelligence and digitally altered content as Brazil approaches the vote.

With AI technology making it increasingly difficult for voters to distinguish authentic recordings from synthetic ones, the case could also become an important reference point in discussions over electoral integrity and the use of emerging technology in Brazilian politics.
