Former Kiambu Governor Ferdinand Ndung’u Waititu continues to grapple with legal woes as the hearing of his 2024 criminal case has been postponed to next week.

Waititu, who is currently serving a corruption-related sentence at Kamiti Maximum Prison, faces charges stemming from remarks he allegedly made on September 29, 2024, during a public gathering at Ruiru Stadium in Kiambu County.

According to a charge sheet dated October 1, 2024, the former governor is accused of making statements targeting various groups including hustlers, market vendors, boda boda operators, clergy, and teachers that were deemed provocative and capable of inciting violence against political figures.

In his speech, Waititu reportedly criticized President William Ruto over the impeachment motion against former Deputy President Rigathi Gachagua, declaring that “If Gachagua goes home, Ruto will also go home.”

The prosecution argues that the remarks violated Section 94(1) of the Penal Code, which outlaws offensive conduct likely to cause a breach of the peace. They allege that Waititu’s statements were made intentionally to stir public tension.

Although he has already been formally charged, the court has adjourned the case to next week to allow for further preparations.

Waititu remains in custody at Kamiti Prison as the Office of the Director of Public Prosecutions (ODPP) continues to pursue the case.
