Former Kiambu Governor Ferdinand Ndung’u Waititu has informed a Nairobi court that he has secured a bank guarantor in his corruption-related case, for which he is currently serving a sentence at Kamiti Maximum Prison.
Appearing before Trial Magistrate Rose Ndobi on Tuesday during the mention of his separate hate-speech case, Waititu through his legal counsel confirmed that he had obtained a Ksh. 53 million bank guarantee. This guarantee is a critical requirement in his application for release, having been in custody since February 2025.
The court noted that once the Ksh. 53 million guarantee is paid, Waititu may be freed, as his bond terms in the hate-speech matter remain valid. Magistrate Ndobi has scheduled the hearing of the hate-speech case for January 15, 2026.
The charges stem from remarks allegedly made by Waititu on September 29, 2024, at Ruiru Stadium in Kiambu County. According to the charge sheet, the former governor is accused of directing inflammatory statements at groups including hustlers, market vendors, boda boda operators, clergy, and teachers. The prosecution argues that these remarks were intended to provoke a breach of peace and suggest violent consequences against political figures.
The alleged conduct contravenes Section 94(1) of the Penal Code, which criminalises offensive behaviour likely to incite public disorder. Prosecutors maintain that Waititu’s statements were made publicly with the intent of generating tension among his audience.
