Nairobi, Kenya – The High Court has directed that the succession case involving the estate of the late Justice David Majanja be urgently placed before the presiding judge, citing concerns over the deteriorating health of one of the beneficiaries, Gerishon Majanja, who is reportedly bedridden.

The matter was last mentioned before Justice Chemitei, who instructed the parties to file additional documents to clarify certain aspects of the case.

Urgency Raised by Parties

Counsel representing Gerishon Majanja and Jason Oudo, alongside counsel for beneficiaries Janet, Louis, and Allan Majanja, requested that the court expedite the proceedings given the health condition of Gerishon.

During the virtual hearing, the father of Justice David Majanja appeared before the court, underscoring the urgency of resolving the matter without further delay.

Court’s Directive

Acknowledging the urgency, the court ordered that the file be placed before the presiding judge for immediate attention.

“These orders are of immediate effect. We will revisit the matter at that stage,” Justice Mwamuye stated.

The court emphasized that the matter should now proceed without postponement, ensuring that the welfare of the beneficiaries is prioritized.

Broader Interest

The case has attracted public interest due to the involvement of the late judge’s family and the implications for succession law. Observers note that the proceedings highlight the importance of timely resolution in estate matters, particularly where the health and welfare of beneficiaries are at stake.

All parties have been directed to log in to the presiding judge’s court for further directions, with the expectation that the case will move forward expeditiously.
