A Nairobi court has dismissed all charges against Kenyan TikTok content creator and entrepreneur Kakan Maiyo, ending a high-profile case that had drawn widespread attention to freedom of expression and social media regulation in the country.
Maiyo, who also runs a logistics company, was arrested on July 10, 2025, accused of inciting violence against police officers through his online content. He spent two nights in police custody and was released on Ksh.10,000 cash bail.
In her ruling, Principal Magistrate Rose Ndombi stated that the alleged offences, as framed in the charge sheet, were no longer recognized under the law, effectively nullifying the case against him.
Controversial Content
Maiyo gained popularity for his social media content that highlighted alleged government failures, police brutality, and for marketing his logistics business. One of his most viewed TikTok videos included a warning to security officers involved in enforced disappearances of government critics:
“A time is coming when you will go to abduct someone and you will not return to your stations alive. Mark my words… No amount of arrest, abduction, or killing will silence Kenyans. It is a waste of time.”
The video went viral and led to heightened scrutiny from authorities. In July 2025, footage circulated showing three plainclothes officers pinning Maiyo to a wall at Kimathi House, Nairobi, before escorting him away. The Directorate of Criminal Investigations (DCI) later said detectives had traced him to his logistics company’s office.
Legal Developments
Following his release on July 11, Maiyo’s legal team argued that the charges were unfounded, stating that his remarks did not meet the legal threshold for incitement. His phone had been confiscated during police interrogation.
After the court ruling, Maiyo’s lawyers announced plans to move to the High Court seeking damages and compensation for the ordeal.
Maiyo’s case has sparked national debate on social media freedom, government accountability, and the limits of speech against public officials and security agencies in Kenya.
