The High Court in Nanyuki has sentenced Moses Njagi Wachira to 35 years in prison after finding him guilty of murdering John Maina Gathogo following a barroom disagreement in 2017.

According to the Office of the Director of Public Prosecutions (ODPP), Justice A.K. Ndungu delivered the sentence after the prosecution team led by counsels Lucas Tanui, Jackson Motende, and Esther Kimani presented overwhelming evidence against the accused.

The court heard that on October 18, 2017, Gathogo was drinking at Gitinga Bar when he accidentally spilled Njagi’s beer after knocking down a table. The incident triggered a confrontation between the two men.

Although the bar owner intervened and temporarily calmed the situation, Njagi later assaulted Gathogo.

Victim’s Final Account

Moments after the altercation, Gathogo was found near the bar with severe burn injuries and rushed to hospital. Before his death, he informed his brother that Njagi had assaulted him following the confrontation.

A postmortem report presented in court confirmed that the cause of death was multiple burn injuries.

Justice Ndungu ruled that the prosecution had proved its case beyond reasonable doubt, establishing that Njagi was responsible for the fatal assault. The judge emphasized that the evidence including the victim’s dying declaration and medical findings was consistent and credible.
