The High Court in Nyeri has sentenced police officer William Muriuki Nyaga to 30 years in prison after finding him guilty of manslaughter in the killing of Stephen Ndiuni at Equator Springs Hotel in Gwa Kungu, Nyahururu, in 2020.
Court Ruling
Justice Kiarie W. Kiarie ruled that Nyaga grossly abused his authority when he assaulted Ndiuni, leaving him critically injured.
“To whom much is given, much is equally expected,” the judge observed, noting that Nyaga had failed in his duty as a law enforcement officer entrusted to protect life and property.
Although Nyaga was initially charged with murder alongside two civilians, the court reduced the charge to manslaughter after determining that the prosecution had not proved malice aforethought, a key requirement for a murder conviction.
Details of the Incident
The court heard that on May 24, 2020, Stephen was suspected of involvement in an altercation at the hotel. Without verifying the allegation, Nyaga, accompanied by others, attacked him. Despite Stephen’s pleas of innocence, the officer repeatedly beat him with his boots and a stick, leaving him helpless.
Justice Wakiaga, in a separate ruling delivered today, stated that Nyaga “betrayed the public’s trust by brutally beating the deceased and leaving him overnight to die a painful death.”
Investigations and Representation
The case was investigated by the Independent Policing Oversight Authority (IPOA), while International Justice Mission (IJM) – Kenya represented the victim’s family during the trial.
Conclusion
The sentencing underscores the judiciary’s firm stance against police misconduct and abuse of authority. By imposing a lengthy prison term, the court reaffirmed the principle that law enforcement officers must be held accountable when they violate the very trust placed in them by the public.
