A Nairobi woman, Tabitha Munee Mutua, was arraigned on Wednesday, November 26, 2025, at Milimani Chief Magistrate Court, facing charges of obtaining money by false pretences and conspiracy to defraud. The charges, brought under Sections 313 and 317 of the Penal Code, stem from allegations that she defrauded her boyfriend, Moses Kiplagat Toroitich.

According to the charge sheet, Munee, together with others not in court, allegedly obtained KSh 1,674,000 from Toroitich by falsely claiming she could involve him in a road construction tender awarded to her company, Thomas Construction Limited, by the Kenya Rural Roads Authority (KeRRA) in Makueni County.

“Tabitha Munee Mutua, on diverse dates between November 15 and November 18, 2024, at Nairobi CBD, jointly with others not before the court, with intent to defraud, obtained KSh 1,674,000 from Moses Kiplagat Toroitich by falsely pretending that you were in a position to incorporate him in a road construction project awarded by KeRRA Makueni region to your company, Thomas Construction Limited, a fact you knew to be false,” part of the charge sheet reads.

Munee pleaded not guilty to both charges. Her lawyer, Kiseve, argued for lenient bond and bail terms, noting that Munee is a single mother of a five-year-old child and that she and the complainant remain in a relationship, suggesting the matter could be resolved outside of court.

Magistrate Dolphina Alego granted Munee a bond of KSh 1 million with a surety of equal value, or alternatively, KSh 500,000 cash bail with two contact persons. Pre-trial proceedings are set for December 3, 2025.

After her release, Munee addressed the court, claiming she had initially been defrauded by the complainant, who had given her KSh 1.2 million for the project. The total amount allegedly owed, including interest, was KSh 1,674,000. She stated that she had already repaid KSh 225,000 under a revised agreement without the interest and was in the process of repaying the remaining balance when she was arrested.

“Naomba mahakama inihurumie, mheshimiwa. Nikona mtoto mdogo na sina hio pesa,” Munee pleaded, appealing for the court to reduce the bond and bail requirements due to her financial constraints and responsibilities as a single mother.

The case highlights a complex dispute involving alleged financial misconduct intertwined with personal relationships, with the court set to provide further directions in December.
