The Directorate of Public Prosecution (DPP) has strongly opposed the release of Police Constable Klinzy Baraza Masinde on bail or bond as he awaits trial for a murder charge.
During a court appearance before Justice Margaret Muigai on Wednesday, November 19, 2025, Senior Assistant Director of Public Prosecutions Gikui Gichui raised concerns about the potential for the accused to interfere with victims and witnesses if granted bail. The DPP also highlighted the seriousness of the offence and the need to ensure public safety.
Gichui further noted uncertainties regarding the accused’s court attendance, as the probation report did not clarify how Masinde would fund travel to court or provide details about his rural residence, where he intends to stay. “The accused was based at Kayole, but now he intends to go home. We do not have enough information about where that locality is or who will be responsible for him. We have a high fear that he will abscond and fail to attend court in this manner,” Gichui stated.
The DPP urged the court, if it were to consider bail, to wait until key witnesses have given their testimony to safeguard the integrity of the case. “Before bail is granted, our key witnesses should be heard by this court so as to sufficiently ensure the integrity of their testimony,” Gichui added.
While the probation report indicated that the accused’s mother is willing to host him at her rural home, the State maintained that this does not alleviate the risks of absconding or witness interference.
The court is yet to make a ruling on the bail application.
