Prominent city advocate Joseph Kinuthia Nyambura, popularly known as Lawyer wa Mtaa, has filed a petition at the High Court seeking to compel the Independent Electoral and Boundaries Commission (IEBC) to include Embakasi North Constituency in the ongoing continuous voter registration exercise.

In his certificate of urgency dated October 2, 2025, Kinuthia argues that Gazette Notice No. 12009, issued on August 27, 2025, unlawfully excluded Embakasi North from the list of constituencies where voter registration began on September 29, 2025.

He claims that this omission has disenfranchised voters and potential voters in the constituency, especially given that a by-election is scheduled in Kariobangi North Ward, which falls within Embakasi North.

“The delay and indefinite suspension of the voter registration process in Embakasi North Constituency is likely to have significant ramifications, particularly on the number of newly registered voters,” Kinuthia stated in his application.

The lawyer, who is himself a registered voter in Embakasi North, is seeking conservatory and mandatory orders compelling the IEBC to review the gazette notice and immediately commence voter registration in the constituency, excluding Kariobangi North Ward pending the petition’s hearing and determination.

Kinuthia further contends that the IEBC’s action violates the constitutional rights of Embakasi North residents, as it denies them the opportunity to register and participate fully in democratic processes.

The High Court is expected to issue directions on the matter in the coming days as the case adds to growing public interest in the transparency and inclusivity of Kenya’s voter registration exercise.
