The Office of the Director of Public Prosecutions (ODPP) has opposed the release on bail of a 74-year-old Kenyan man wanted in the United States to face multiple cybercrime-related charges.

Prosecutors told the court that Godfrey Mbogori is being sought by U.S. authorities following an arrest warrant issued by the United States District Court for the Eastern District of Virginia on November 15, 2023.

Allegations of Cybercrime and Identity Theft

According to the ODPP, Mbogori faces several charges under Title 18 of the United States Code, including conspiracy to commit computer intrusions, conspiracy to commit wire fraud, and aggravated identity theft.

The prosecution stated that the charges also include aiding and abetting in cybercrime activities, which form part of an ongoing investigation by U.S. authorities.

Arrest Following INTERPOL Red Notice

Court documents show that Mbogori was arrested on February 19, 2026, in Meru by officers from the Anti-Terrorism Police Unit and the Joint Anti-Terrorism Task Force.

The arrest followed the issuance of an INTERPOL Red Notice requesting international assistance in locating and detaining the suspect pending extradition.

Formal Extradition Request from the United States

The court heard that Kenyan authorities received a formal extradition request from the United States on February 26, 2026.

Prosecutors argued that Mbogori should remain in custody as extradition proceedings continue, citing the seriousness of the alleged offences and the risk that he could flee if released on bail.

International Legal Obligations

The ODPP also emphasized that Kenya has international obligations to cooperate in the fight against transnational crime.

According to prosecutors, releasing a suspect who is the subject of an active international arrest request could compromise the integrity of the extradition process and undermine the country’s commitments under international law.

The court is expected to determine whether the suspect will remain in custody as the extradition case progresses.
