NAIROBI, Kenya — The Political Parties Disputes Tribunal (PPDT) has overturned the decision by the Registrar of Political Parties to decline reservation of the name Linda Mwananchi Movement, directing the Registrar to reserve the name within seven days.

The ruling, delivered on Wednesday, September 30, 2026, follows a dispute involving Suba South MP Caroli Omondi, Pauline Njoroge and former Law Society of Kenya president Faith Odhiambo, who identified themselves as founders of the proposed political movement.

The applicants had challenged the Registrar's refusal to reserve the name Linda Mwananchi Movement and its proposed abbreviation, LMM.

Tribunal Sets Aside Registrar's Decision

In its ruling, the Tribunal found that the Registrar's decision lacked legal justification and amounted to a denial of the applicants' right to form or participate in the formation of a political party.

The Tribunal consequently set aside the decision and ordered the Registrar to proceed with reservation of the name within seven days.

The dispute had previously been linked to competing claims surrounding the LINDA political identity, with the Linda Mwananchi movement seeking formal recognition ahead of the 2027 General Election.

Unregistered LINDA Party Removed From Proceedings

The Tribunal also considered the participation of the Liberty National Democratic Alliance (LINDA), commonly referred to as Linda Party.

It determined that LINDA was not a fully registered political party and therefore lacked the legal capacity to sue, be sued or participate in proceedings in its own name.

As a result, the Tribunal struck out pleadings filed by LINDA as an interested party.

The ruling follows months of dispute over the competing political identities.

Earlier proceedings had involved the Registrar's refusal to reserve Linda Mwananchi, initially citing public-interest considerations. The applicants subsequently challenged the decision before the Tribunal.

What the Ruling Means

The Tribunal's order specifically directs the Registrar to reserve the Linda Mwananchi Movement name within seven days.

However, the ruling did not grant every remedy requested by the applicants. The Tribunal allowed the challenge to the Registrar's decision and ordered reservation of the name, while declining the applicants' other prayers.

The decision is significant as political formations continue preparing for Kenya's 2027 General Election, with parties and movements seeking to establish their legal identities and organisational structures ahead of the electoral cycle.

The ruling concerns the reservation of a political party name; it does not, by itself, constitute full registration of the proposed political party.
